Terms and Conditions
§1. General Provisions
The German Society for Mass Spectrometry (DGMS) organizes the event using the "Indico" management system.
§2. Fees
The event may be subject to a fee. The fee may be tiered based on the registration time.
§3. Notes
- Participants are all individuals who register for the event through the web interface and pay any applicable fees.
- No distinction is made between individuals or groups.
- Participants who are presenting a contribution are asked to provide the required information during registration.
§4. Confirmation
Registration and payment of the participation fee will be confirmed by email.
§5. Cancellation
- If the participant cancels their registration by a certain deadline, they will be refunded a portion of the fees paid.
- If the participant cancels after the deadline, there will be no refund.
- Bank or credit card fees are not refundable.
§6. Event Cancellation or Postponement
- The DGMS reserves the right to change the event program, venue, or schedule.
- If compelling reasons prevent the event from being held properly, the DGMS may cancel or postpone the event. In such a case, the DGMS will inform all registered participants immediately.
- If the event is canceled, the participant is entitled to a full refund of the fees, provided that there is no higher force at play.
- If the event can only be held by postponement, the booking remains in effect. However, each participant has the right to cancel their booking and claim a full refund of the fees.
§7. Force Majeure
- An event of force majeure is an event that prevents one of the parties (the "non-performing party") from fulfilling one or more of its contractual obligations, provided that (i) the non-performance is due to a circumstance beyond the control of the non-performing party, (ii) the occurrence of the circumstance at the time of contract conclusion could not reasonably have been foreseen, and (iii) the effects of the circumstance could not reasonably have been avoided or overcome.
- In the event of an event of force majeure, the non-performing party is released from its obligation to fulfill its contractual obligations and from any claims for damages due to a breach of contract from the time the event of force majeure prevents the performance of the obligations.
§8. Data Protection Agreement
By registering, the participant agrees to the use of their data by the organizers of the event. Personal data will not be passed on to third parties. The agreement can be revoked informally by sending an email to the contact address specified.
§9. Photography and Video Recording
By registering, the participant agrees that photographs and videos may be taken during the event, in which the participant may be visible. The recordings are for public relations purposes and may be published in print and online media. If photographs or videos focus on individual persons, those persons have the right to inform the photographer at any time that they do not want to be photographed or that the photograph should not be published.
§10. Right of Withdrawal for Consumers
A consumer is any natural person who enters into a legal transaction for purposes that are outside their trade, business, or profession. Consumers have a statutory right of withdrawal in the case of distance contracts. Distance contracts are contracts in which the parties use only remote communication means to conclude the contract, without being physically present at the same time (e.g. by phone, fax, email, or web form).
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of contract conclusion.
To exercise your right of withdrawal, you must inform us in writing (e.g. by letter, fax, or email) of your decision to withdraw from the contract.
To meet the deadline, it is sufficient to send the notification of withdrawal before the end of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments we have received from you immediately and at the latest within 14 days from the date of receipt of your notification of withdrawal. We will use the same payment method that you used for the original transaction, unless you have agreed otherwise. In any case, we will not charge you any fees for the refund.
§11. Liability
- The DGMS is liable for the breach of essential contractual obligations, i.e. obligations that make the proper performance of the contract possible in the first place, whose breach would jeopardize the achievement of the contract purpose, and on whose fulfillment the participant regularly relies. The liability is limited to intent and gross negligence, and in the case of simple negligence, to the typical, foreseeable damage.
- Otherwise, the DGMS is only liable to the participant for damages caused by intent or gross negligence. In the case of gross negligence, the liability is limited to the typical, foreseeable damage.
- The liability under paragraph 2 for indirect damages and consequential damages (e.g. lost profits or other property damage) is excluded in the case of gross negligence.
- The above-mentioned exclusions and limitations of liability do not apply in the case of a breach of life, body, or health or in the case of guarantees, as well as in the case of claims under the Product Liability Act.
- The above-mentioned exclusions and limitations of liability also apply in favor of the representatives of the DGMS.
§12. Applicable Law, Place of Jurisdiction
This contract is governed exclusively by the law of the Federal Republic of Germany. The place of performance and jurisdiction is Bremen.
